Jose Padilla, who was arrested for conspiring to detonate a radioactive “Dirty Bomb” as part of an al-Quaida terror attack was sentenced yesterday to 17 years and 4 months in prison . Mr. Padilla was convicted in August with two other defendants for conspiring to support worldwide al-Quaida initiatives.
This case, a primary case involving terrorism, was interesting on several fronts.
The first issue is the legal processing and aducation. The government requested a life sentence, (and the charges carry a 30 to year sentence), yet the sentencing judge opined that Mr. Padilla endured harsh prison conditions (the defense attorneys alleged that Mr. Padilla was routinely tortured) for over 3 years while awaiting trial. Were it not for Mr. Padilla’s previous criminal record, the sentence may have been even less.
The second issue is law enforcement policy. Mr. Padilla was born and raised in the United States. Investigating terror cells from abroad is very difficult, as is “homegrown” terrorists. Public safety personnel must remain vigilant in counter terrorism initiatives, however, civil liberties must be respected. The homegrown terrorists represent yet another challenge in the evolution of public safety.
